This agreement describes the Terms and Conditions of the services provided by Capital Flores (“Capital Flores”) through the website https://www.capitalflores.com/ (the “Site”), and mobile applications (together, the “Platform”) for the acquisition by third parties (the “Users”) of floral arrangements and other gift products.
By using our services, Users acknowledge and accept that these Terms and Conditions are mandatory and binding. Acceptance of these terms governs the contractual relationship between the parties and any legal consequences arising from it.
User Capacity
To use the Platform, Users must have the legal capacity to enter into contracts. Minors or users previously suspended by Capital Flores are prohibited from using the service.
I. Registration
Users must provide accurate, current, and complete personal or corporate information. Users are responsible for any false or outdated information provided to Capital Flores or its affiliated providers.
II. Right to Cancel Registration
Capital Flores reserves the right to prohibit, cancel, or remove the registration of any User who fails to comply with these terms, especially in cases of fraudulent behavior or attempts to purchase prohibited items.
III. Services
1. Product Sale and Preparation
a) Requests: Products are prepared and distributed by our network of Affiliated Providers. It is the User's sole responsibility to provide accurate delivery data.
b) Products: All products are subject to availability. We reserve the right to substitute components with items of equal value and quality. Some flowers may be delivered in bud form to ensure a longer vase life.
c) Image Validation: For specific products, we offer an image validation service. Users have 10 minutes to approve or reject the photo of the finished arrangement before dispatch.
2. Delivery
Delivery drivers will wait a maximum of 10 minutes at the destination. If delivery is not possible:
- For private residences, the User will be notified for rescheduling.
- Second delivery attempts may incur additional fees.
- If the recipient refuses the product, the service is considered completed without a refund.
IV. Fees and Billing
Prices include VAT for deliveries within Mexico. Capital Flores reserves the right to modify prices based on geographic zones or seasonal demand.
Payment Methods: We accept credit/debit cards (Stripe/EVO), PayPal, SPEI Transfers, and OXXO deposits. Cash payment receipts must be sent to legales@capitalflores.com.
V. Cancellations and Refunds
Due to the perishable nature of floral products, quality claims must be made within 48 hours of delivery. For non-perishable items, the return period is 30 days in original packaging.
VI. Intellectual Property
All content on the Site, including software, algorithms, and product designs, is the exclusive property of Capital Flores and is protected by international copyright laws.
VII. Jurisdiction
For any legal disputes, the parties submit to the jurisdiction of the competent courts in the City of Mazatlán, Sinaloa, Mexico.
VIII. Orders with Pending Transfer Payment
In the event that an order with a transfer payment method is not settled and its cancellation is not requested before the order goes out for delivery, the User accepts and authorizes that the total amount of the order will be collected directly at the recipient's address at the time of delivery by the assigned logistical staff.
